Constitutional Rights Sovereign Immunity
Context:
Ensuring that agencies and their administrators do not violate citizens’ Constitutional rights has always been a concern. The evolution of sovereign immunity has now transitioned to qualified immunity whereby administrators may now be sued personally for violating a person’s Constitutional rights. This change, and others, may have implications on how administrators make decisions which could affect administrative efficiency.
