Scenario 1

Paula White, hereby referred to as the prospective wife, and James Meyerson, hereinafter considered to as the prospective husband, hereby agree on x/x/20xx, as follows:

  1. Prospective wife Paula White and Prospective husband James Meyerson contemplate marriage later this year and so wish to establish their respective rights regarding each other’s income and property that they currently own or have acquired before entering into a marriage,
  2. Prospective wife and Prospective husband hereby make full disclosure about their financial assets and properties to each other,
  3. In exception of the provisions below or otherwise stated, prospective wife and husband waive the following rights in case a divorce occurs:
  • No spouse will be liable to sue or claim any share to the financial assets or properties that the two hold now and,
  • No spouse would have a legal right in a court of law to claim for properties registered to either spouse of their family before the time of marriage.
  • Any increase in value of either spouse’s property after marriage shall not be shared on divorce, instead, clause 1 shall still hold for this is a separate property
  • No claim of the properly shall be legal provided the property was acquired before or during the cohabitation period of the parties

Other relevant exceptions in their pre-marital agreement include:

  • That all properties acquired during the period of marriage shall be equally shared between the two spouses,
  • The two spouses shall maintain all temporal and permanent properties acquired before or after marriage

Additional provisions would include:

  • Both prospective wife and prospective husband shall be represented by independent and separate litigators of their own choosing,
  • In property maintenance, the two prospective spouses shall keep separate income statements and assets value and independently provide their legal counsels with their own respective income records

This agreement shall take effect immediately upon the solemnization of the spouses marital contract.

I HAVE READ THE ABOVE AGREEMENT, CONSIDERED ITS IMPLICATIONS, UNDERSTOOD ITS CONTENTS FULLY, AGREED TO ITS TERMS AND CONDITIONS, AND VOLUNTARILY AGREE TO ITS EXCECUTION.

Scenario 2

Each pre-marital agreement is unique. This agreement was reached as at x/x/20xx by and between Frank Holloway and his intended wife. In this draft agreement, three terms and conditions were reached upon that;

  • The husband and wife shall not bear children,
  • In the event the wife conceives, she shall terminate the pregnancy, and
  • If for any reason she fails to end the pregnancy, Frank shall not be liable for child support.

Cocco, Cocco & Cocco law firm hereby wishes to review the draft agreement submitted by the two of you to our office. The law requires that the two parties sign the agreement so that it becomes valid, legal, and defendable in a court of law.

Frank and his intended wife clearly state and declare their marriage goals. However, this agreement is to some extend discriminative of the intended wife. Although the intended wife warrants her lack of interest of conceiving or getting pregnant to term, there are those circumstances under which she cannot terminate pregnancy. In family contract, the law requires that;

  • A wife shall not terminate pregnancy if the physician advices that pregnancy termination would be fatal, or if the act would cause adverse effects to her health

In case Frank’s wife becomes pregnant, and physicians’ advice the couple of the risks associated with ending this pregnancy, then clause 3 of their pre-marital agreement shall not hold in any court of law and that;

  • Frank shall be compelled by the rule of law to take full responsibility of the wife’s child support.
  • Pre-marital agreements do not hold in child support cases.

Enclosed in this letter is my review as an attorney to Frank and his intended wife’s pre-marital agreement. All contractual exclusions hereby contained and signed upon me are enforceable in a court of law.
