Competition Law – Apple Sales

Part I: In Case T-892/16, Apple Sales International and Apple Operations Europe v Commission [2017] O.J. C-053/46, the applicants seek annulment of the decision of the European Commission of 30 August 2016 on State aid SA 38373 (2014/C) implemented by Ireland to Apple by claiming that the decision exceeds the Commission’s competence under Article 107 (1) TFEU by attempting to redesign Ireland’s corporate tax system.

Acting on behalf of your own choice of the parties, namely (i) Apple Sales International and Apple Operations Europe or (ii) the Legal Service of the European Commission, you are tasked to present a brief legal opinion on how the above ground affects redistribution and undistorted competition.
