Lilly Ledbetter Fair Pay Act of 2009 is a federal statute in America that was put into law by the American President Barack Obama on 29th January 2009. It amends the Civil Rights Act of 1964 and ensured to make the workplace conducive offering equal pay irrespective of race, gender and other factors that might influence the workplace inculcating pay discrepancies. The pay discrepancies seem to be only used where employees in the similar job category undertake similar work description while not paid the same salaries as some of their counterparts. The dissimilarity in salary allocation can be because of policies practices by the company or some discrimination emanating from gender, religious, racial or cultural disparities. The Act was signed by President Obama in 2009 to make sure that the women were given similar compensations as the men because various organizations practiced pay discrepancy.

The objective of this paper is to elucidate how pay equality is vital for American citizens and its benefit to the national development. I suggest that all organizations should perform same pay measures within the workplaces to ensure balance in various aspects such as gender, race including ethical and legal measures.  Historically, there has been a wage gap for women in America and the national median annual pay for women with full-time work is to the tune of $41,554 while the median is $51,640.There has been a substantial wage gap in America amounting to $10,086 related to gender disparity. The wage gap is even wider is distributed infirm of race, gender, and color. The constitutional composition in relation to the Civil rights and the trade unions advocate for the elimination of the discrepancies to scrap out the wage gap as it escalates discrimination within the organizations (Klar, 2018). In the Modern American society, the Lilly Ledbetter Fair Pay Act (2009) advocates for the rights of equal pay to women in combination with constitutional and trade union rights. The gender discrimination has been rampant within the American society prompting the initiation of the civil rights movement advocating for the equity and diversity in workplaces. The incorporation of the Lilly Ledbetter and the civil rights Act of 1964 that was also put into laws ensures every individual in the American society is given similar chances and responsibilities irrespective of their gender orientation (Lyons, 2012). There is the importance of the application of the Lilly Ledbetter Act is the addressing of the historical cases and Acts for pay that have influenced the American citizens in their workplaces. The Lilly Ledbetter Fair pay Act 2009 has incorporated some of the work policies that were neglected by the civil right bringing gender equity and fairness in all aspect of life.

The Americans think the Supreme Court has a final arbiter of the entire law and legal requirements but there is a constitutional system of separation of powers and check and balances. The Fair Pay Act and the Equal Employment Opportunity Commission (EEOC) are the Acts opposed to putting check and balances into the Lilly Ledbetter case allowed by President Obama. The Lilly Ledbetter Fair Pay Act of 2009 has the mandate to effectively keep checks and balances in the constitution through overturning the Supreme ruling. The Ledbetter case was interpreted properly in various aspects such as the provision of the Title VII of the Civil Rights Act of 1964 prohibiting employment discrimination on the of sex, race, and discrimination(Johnson, 2010). The Acts related to the Lilly Ledbetter case are important in the ruling made in the Supreme Court and the congressional debates. The Act also concentrates on the days a claim should be initiated to the Title VII having a provision of 180 days and some states to use 300days for filing a complaint. The Act has really advocated most for the rights of women In America which has been compromised for long through abuse by disclosing how the country operates on the issues of equality and gender at workplaces. It keeps various check and balances on the constitutional and civil rights compositions to ensure fair labor practices within America. The Act supports the women rights checking on how various organizations have been abusing women rights for the past years. The media does not reveal the issues regularly to be checked by responsible checks and balance controls making the organizations discriminate against women in relation to pay. The bias of media coverage on the policy operations that has been enhanced to make the media have access to proper information and policies regarding and initiatives of the Act and its influences on the society.

Explains how the policy impacts voting and the election process.

The policy influences the voting process in America because there are people supporting the policy and others who are opposed to the initiation of the policy as they view is as a threat to the society. Some people in the society attribute women empowerment to threat and insecurity in the society. This makes the people against the policy not to vote for the government supporting and implementing such policies in the society. During the voting process, women would be willing to vote for the side supporting their value within the society influencing the voting and the political process (Dunn, 2018). The gender-based laws are shown and are impacted by the representation within the government and even in the organization boardrooms. There is the influence of the policies by the women serving in various roles because of the lack of majority vote in various issue regarding women influence. The issue evolves from gender or racial equality that has made the congress and the senate culpable to discrepancies because the elected officials don’t comply with gender balance impacting the policy.
